Terms of Use

01 Agreement

These Terms are a contract between you and [TODO: LEGAL ENTITY] (“we”, “us”) covering your use of the Roadmeter app for iPhone. By downloading or using Roadmeter, you accept them. If you do not accept them, delete the app.

Your use of Roadmeter is also governed by Apple's Licensed Application End User License Agreement, at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with Apple's, Apple's prevail as between you and Apple.

02 Licence

We grant you a personal, non-transferable, non-exclusive licence to use Roadmeter on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, redistribute, sell, rent, reverse-engineer, decompile, or attempt to derive the source code of the app, except where that restriction is prohibited by law.

Roadmeter, its dial designs, artwork, sounds, and name remain ours. Your trips and your exported files remain yours; we claim nothing in them.

03 Accuracy, safety, and what Roadmeter is not for

This section is the substance of the box above, in contract form.

• Speed readings are estimates. They are derived from GPS and are affected by signal quality, satellite geometry, obstructions, atmospheric conditions, device hardware, and iOS power management. They may be delayed, wrong, or unavailable, and they may differ from your vehicle's dashboard and from any measurement made by law enforcement.
• Speed limits are user-entered. Roadmeter contains no database of posted speed limits and does not detect them. Any limit shown was entered manually by you or is a default value; it carries no assurance that it matches the limit in force where you are.
• Alerts may not fire. Audio, spoken, and haptic alerts depend on your device volume, silent switch, Focus modes, connected audio, and battery state. Never rely on an alert as your only check.
• Calibration is your adjustment, not a certification. The calibration offset applies a correction you choose. It does not make a reading official or verified.
• Not for regulated or professional use. Roadmeter is not fit for evidentiary, forensic, navigational, aviation, marine, commercial fleet compliance, tachograph, motorsport timing, or any other use where an inaccurate reading could cause harm or legal consequence.
• You are responsible for how you drive. You alone are responsible for complying with all traffic laws and for the safe operation of your vehicle. We are not liable for any fine, penalty, licence sanction, insurance consequence, collision, injury, or loss arising from your speed or your use of Roadmeter.

04 Subscriptions and purchases

Roadmeter is free to download. Roadmeter Pro unlocks the full dial collection, an unlimited trip history, and the full accent set. It is sold as an auto-renewing subscription or as a one-time lifetime purchase.

How renewal works

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically at the same price unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within 24 hours before the period ends.
• The 3-day free trial applies to the yearly plan only, once per Apple Account. If you do not cancel before the trial ends, it converts to a paid year automatically. Starting a trial and then buying another plan forfeits the unused part of the trial, as required by Apple.
• Prices are shown in your local currency in the app before you confirm, and may differ from the US prices above because of local taxes and App Store regional pricing. If we change a price, Apple will ask you to agree before it takes effect.

Cancelling

Manage or cancel in Settings → your name → Subscriptions on your iPhone, or in the App Store app. Cancelling stops future renewals; Pro stays active until the end of the period you have already paid for. We cannot cancel a subscription on your behalf — only Apple can.

Refunds

Apple is the merchant of record and handles all refunds under the App Store Terms of Service. Request one at reportaproblem.apple.com. We have no ability to issue a refund directly, though we are glad to help you make the case. Nothing here limits any statutory right of withdrawal or refund you have under local consumer law.

Restoring

Use “Restore Purchases” in Settings inside the app to re-unlock Pro on a new device or after reinstalling. Restoring requires the same Apple Account used for the original purchase.

05 Privacy

Roadmeter processes your location on your device and does not transmit it. Full detail is in the Privacy Policy, which forms part of these Terms.

06 Acceptable use

Do not use Roadmeter to break the law, to encourage or coordinate unlawful speeding, or in any way that endangers other road users. Do not attempt to circumvent the purchase system or interfere with the app's operation.

07 Availability and changes

We may update Roadmeter, change or withdraw features, or discontinue the app. We will not remove a feature that a lifetime purchase was sold on without a reasonable notice period. Roadmeter depends on your device's GPS hardware and on Apple's services, and we do not warrant uninterrupted or error-free operation.

08 Warranty disclaimer

To the fullest extent permitted by law, Roadmeter is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

09 Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, fines, penalties, or vehicle or property damage, arising from your use of or inability to use Roadmeter — even if we were told such damages were possible.

Our total liability for any claim relating to Roadmeter is limited to the greater of the amount you paid us for Roadmeter in the twelve months before the claim, or USD 50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.

10 Apple's position

Apple is not a party to these Terms and has no responsibility for Roadmeter. Apple has no obligation to provide maintenance or support for Roadmeter. If Roadmeter fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Any claim relating to Roadmeter's possession or use — including product liability, legal or regulatory non-compliance, and consumer protection claims — is our responsibility, not Apple's. We are responsible for investigating and resolving any third-party claim that Roadmeter infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11 Termination

These Terms apply until terminated. They end when you delete Roadmeter from all your devices. We may suspend or end your licence if you materially breach them. Sections 03, 08, 09, and 10 survive termination.

12 Changes to these Terms

We may revise these Terms. The current version always lives at this address, with the date at the top. Material changes will be noted in the release notes of the version they take effect in. Continuing to use Roadmeter after a change means you accept the revised Terms.

13 Governing law

These Terms are governed by the laws of [TODO: JURISDICTION], and the courts of [TODO: JURISDICTION] have exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence, nor of the right to bring proceedings there.
